These Terms and Conditions ("Terms") govern your access to and use of the website hoponhopofftickets.istanbul (the "Platform"), operated by Authentic Day Tour, LLC ("Authentic Day Tour", "we", "us" or "our"), and any Booking you make through it. By using the Platform or making a Booking you agree to these Terms. If you do not agree, please do not use the Platform.
These Terms are written in English, and the English version prevails in the event of any dispute over their interpretation.
I. Definitions
In these Terms:
- Authentic Day Tour, we, us or our means Authentic Day Tour, LLC, the operator of the Platform.
- Booking means a purchase of a hop-on hop-off sightseeing bus ticket or pass through the Platform.
- Booking Confirmation means the confirmation, including your ticket, that we send by email and WhatsApp after your payment is successful.
- Booking Price means the total amount payable for a Booking, including applicable taxes.
- Platform means the website hoponhopofftickets.istanbul.
- Posted Price means the price displayed on the Platform.
- Supplier means the third party that provides the hop-on hop-off service and from which we source the tickets we sell to you.
- Supplier Terms means any additional conditions that a Supplier applies to a ticket or service.
- You or your means any person who accesses the Platform or makes a Booking.
II. About us
Authentic Day Tour, LLC is a company registered in the United States that operates the Platform as an independent booking platform. We sell hop-on hop-off sightseeing bus tickets that are provided by a Supplier. We are not the operator of the transport service itself.
Except where these Terms expressly state otherwise, we are not responsible for the acts, omissions or performance of any Supplier, and we accept no liability for loss, damage or injury arising from the service a Supplier provides. III. Scope
These Terms apply to all use of the Platform and to everyone who visits it, unless we clearly disclose different terms for a specific service. We may change or discontinue the Platform, or any part of it, at any time, but Bookings already confirmed remain valid. By accessing any part of the Platform you agree to comply with these Terms.
IV. Use of the Platform
The Platform is for your personal, non-commercial use. You may not resell tickets purchased through the Platform for commercial purposes without our written agreement. You must be at least 18 years old and legally able to enter into a binding contract.
When you use the Platform you agree to: provide truthful and complete information; use the Platform lawfully; not make speculative or fraudulent Bookings; and have full authority to enter into these Terms. We may refuse access to the Platform at our discretion, including for a breach of these Terms.
V. Booking
You can search for and book hop-on hop-off tickets through the Platform. When you complete a Booking you make a binding offer to purchase, and once your payment is successful we issue a Booking Confirmation by email and WhatsApp containing your ticket and its details.
Please check your Booking Confirmation as soon as you receive it and tell us promptly if anything is wrong. Some tickets are subject to Supplier Terms that create additional obligations; by making a Booking you accept those Supplier Terms, and where they conflict with these Terms, these Terms prevail in respect of your relationship with us.
You are responsible for arriving on time at the relevant stop and for holding any documents required for your trip.
VI. Pricing and payments
Posted Prices are shown on the Platform and generally include applicable taxes unless stated otherwise. Where the Platform shows prices in more than one currency, conversions are performed at the rate applied by our payment processor, and your bank may apply its own fees, which can cause a difference between the price shown and the amount finally charged.
Prices may change until your Booking is completed. Full payment is due at the time of Booking unless stated otherwise. All payments are processed through Stripe’s secure servers; we never collect, store or access your full card details. You confirm that you are authorised to use the payment method you select.
We may decline or cancel any Booking that we reasonably suspect involves fraud, an unauthorised payment or a breach of these Terms. As a booking platform we do not issue tax invoices, but a payment confirmation is available on request.
VII. Ticket delivery and our guarantee
Your ticket is delivered by email and WhatsApp once your Booking is complete.
We guarantee that if the ticket we issue shows a different date, time or option than you selected, or if it is delayed, fails to arrive, or does not work because of an error on our side, we will first try to issue a corrected ticket and, if we cannot, offer you a full refund or an exchange, at your choice.
If the service cannot be provided as described because of the Supplier, for example an unexpected cancellation or closure, we will either rebook you onto an equal or similar service at no extra cost or give you a full refund.
This guarantee does not cover cancellations by you, problems caused by you (such as incorrect information, late arrival, unmet requirements or a no-show), or delays caused by your email settings or incorrect contact details. To make a claim under this guarantee, contact us within 24 hours with your Booking details and reasonable supporting evidence.
VIII. Booking changes, cancellations and refunds
You can cancel your Booking up to 24 hours before your scheduled start time for a refund, and force majeure events qualify for a full refund. Cancellations within 24 hours of the start time, and no-shows, are not refundable. Refunds are made to your original payment method. We may cancel a Booking at our discretion where we suspect fraud or a breach of these Terms, and we will issue a full refund unless the cancellation was caused by fraud.
IX. Your responsibilities and assumption of risk
You are responsible for your own acts and omissions, and for those of anyone you book for. You must arrive on time at the relevant stop, follow the reasonable instructions of the Supplier and its staff, comply with local laws, and hold any documents required for your trip.
You acknowledge that participation carries ordinary risks and, to the maximum extent permitted by law, you assume those risks. The Booking Price does not include insurance, and you are responsible for obtaining any travel or personal insurance you need.
X. Suppliers and Supplier Terms
The hop-on hop-off service is provided by an independent Supplier, from whom you are effectively purchasing. We act only as a booking platform, and the Supplier is an independent contractor, not our agent or employee.
Some tickets are subject to Supplier Terms that become binding when you make a Booking. Except as stated in Section VII and Section VIII, we are not responsible for the acts, errors, omissions or misconduct of a Supplier, or for any personal injury, death, property damage or loss arising from the service.
XI. Disclaimer of warranties
The Platform and all content and services are provided "as is" and "as available", without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the Platform will meet your requirements, or be uninterrupted, timely, secure or error-free, or that the information on it is complete or accurate. You use the Platform at your own risk. Nothing in these Terms excludes any liability that cannot be excluded by law.
XII. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost data or loss of goodwill, even if we were advised of the possibility. Our total liability arising from these Terms or any Booking will not exceed the amount of the Booking giving rise to the claim.
All claims for personal injury, death, property damage or loss arising from the service must be directed to the relevant Supplier. Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited by law.
XIII. Indemnification
You agree to defend, indemnify and hold harmless Authentic Day Tour and its officers, directors, employees and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or any Supplier Terms, your violation of any law, your use of the Platform, your participation in the service, or your violation of any third-party rights.
XIV. Intellectual property
The Platform and all of its content, including text, photographs, images, graphics, designs, icons, software and code, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute, publish or create derivative works from the Platform content, or use it commercially, without our prior written consent.
"hoponhopofftickets.istanbul" and "Authentic Day Tour", together with associated logos and marks, are trademarks of the company. Other trademarks shown on the Platform belong to their respective owners.
XV. Prohibited activities
You agree not to, and not to help anyone else to: use the Platform commercially or unlawfully; access or copy content using robots, scrapers or other automated means without permission; bypass measures used to prevent or restrict access; place an unreasonable load on our infrastructure; frame, mirror or deep-link to the Platform without authorisation; reverse-engineer or attempt to interfere with the Platform; transmit viruses or malicious code; attempt unauthorised access to any system; purchase tickets for commercial resale; or otherwise violate any applicable law. Violations may result in immediate termination of your access.
XVI. Electronic communications
When you use the Platform or contact us by email or WhatsApp, you consent to receiving communications from us electronically, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
XVII. Third-party links
The Platform may contain links to third-party websites provided for reference only. We do not control these sites and are not responsible for their content or practices, and you access them at your own risk.
XVIII. Data protection
We process personal data in accordance with the GDPR, the KVKK and other applicable laws. Full details are set out in our Privacy Policy.
XIX. Fraudulent activities
We have zero tolerance for fraud. Where we suspect fraudulent activity we may contact you to verify a transaction, and if you do not provide the requested information, or we determine that fraud has occurred, we may cancel the Booking and refuse further service without liability. If you receive a suspicious message claiming to be from us, please report it to support@authenticdaytour.com.
XX. Changes to these Terms
We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements or for other operational reasons, and we will update the "last updated" date accordingly. For material changes we will provide a prominent notice on the Platform or notify you by email. Continued use of the Platform after changes take effect means you accept the updated Terms.
XXI. Termination
We may suspend or terminate your access to the Platform at any time, without notice, for a breach of these Terms, suspected fraud or illegal activity, or any other reason we reasonably consider necessary. Termination does not affect Bookings already confirmed. The sections that by their nature should survive, including the disclaimers, limitation of liability, indemnification, intellectual property and governing law provisions, continue to apply.
XXII. Governing law and jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute arising from these Terms or your use of the Platform is subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, to which you consent. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in this section affects the mandatory consumer protection rights available to you under the laws of your country of residence.
XXIII. Assignment
You may not transfer or assign your rights or obligations under these Terms without our written consent. We may assign or transfer these Terms, or our rights and obligations under them, at our discretion.
XXIV. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision will be reformed only to the minimum extent necessary to make it enforceable while preserving its original intent.
XXV. No waiver
No waiver of any provision of these Terms is effective unless made in writing by us. Our failure to enforce any provision does not waive our right to enforce it later.
XXVI. European Union consumer rights
If you are a consumer resident in the EEA, you may normally have the right to withdraw from a contract within 14 days under EU Directive 2011/83/EU. However, Article 16(l) of that Directive removes this right for leisure services provided on a specific date, which includes hop-on hop-off tickets booked for a particular travel date. By making a Booking you acknowledge that this withdrawal right does not apply, and cancellations are instead governed by our Cancellation Policy. Nothing here excludes any mandatory consumer rights that cannot be limited by contract.
XXVII. Online dispute resolution
If you are a consumer resident in the EEA, you may submit a complaint through the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. You can also contact us directly at support@authenticdaytour.com. We are not obliged to participate in dispute resolution before that platform unless required by law.
XXVIII. Entire agreement
These Terms, together with our Privacy Policy and any applicable Supplier Terms, form the entire agreement between you and us regarding the Platform and supersede any earlier communications or agreements.
